These Terms of Service ("Terms") govern your use of the StormClaim mobile application (the "App"), operated by StormClaim ("StormClaim," "we," "us," or "our"). By creating an account or using the App, you agree to these Terms.
StormClaim is a tool for licensed roofing contractors and their teams to track storm activity, document property damage, and prepare insurance claim documentation. It is not insurance, legal, or public-adjusting advice, and using the App does not create an adjuster-client or attorney-client relationship.
You're responsible for the accuracy of the information you enter and for keeping your login credentials secure. You're responsible for all activity under your account and any company account you administer.
The App uses AI (Anthropic's Claude models) to analyze photos and estimate damage, costs, and claim strength, and to extract line items from carrier estimate documents you choose to import. AI analysis is a starting point, not a substitute for professional judgment. You are responsible for reviewing, verifying, and correcting AI-generated damage assessments, cost estimates, imported line items, and reports before relying on them or sending them to a homeowner, adjuster, or insurance carrier. We do not guarantee the accuracy of AI-generated content.
The App generates claim documentation (PDF reports) that you can email or share with insurance carriers and adjusters. StormClaim does not submit claims directly to insurance carriers on your behalf — carriers do not provide a public mechanism for that, and any contact information for a carrier surfaced in the App (phone numbers, portal links) is provided for your convenience only and may change without notice. You are responsible for verifying claim information and for your communications with carriers, adjusters, and homeowners.
If you create a company account and invite team members, you're responsible for managing their access and permissions. Team members can see claims, comments, and activity shared within the company per their assigned role.
The App offers three subscription tiers — Starter, Pro, and Business — each billed monthly through your Apple ID at the price shown in the App at the time of purchase. New subscribers may be offered a 7-day free trial; Apple limits each Apple ID to one free trial per subscription group, so switching between tiers after using a trial does not grant an additional trial period. Subscriptions automatically renew each month unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription anytime in your device's Settings > Apple ID > Subscriptions. Refunds are handled by Apple under their own refund policy — we do not process refunds directly.
You agree not to: use the App for unlawful purposes; submit false or fraudulent claim information; attempt to interfere with or reverse-engineer the App; or use the App to harass or harm others.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT AI-GENERATED ASSESSMENTS ARE ACCURATE, THAT STORM DATA IS ERROR-FREE, OR THAT ANY CLAIM WILL BE APPROVED BY AN INSURANCE CARRIER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORMCLAIM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING DAMAGES RELATED TO DENIED OR UNDERPAID INSURANCE CLAIMS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP IS LIMITED TO THE SUBSCRIPTION FEES YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your account for violating these Terms. You may stop using the App and request account deletion at any time.
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles.
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
